MEMBERSHIP AGREEMENT

1. Parties

1.2) An internet user who fills in the information required by Marios to register on the www.marions.com.tr website and becomes a member (referred to as "Member").

2. Subject of the Contract

The subject of this agreement, which will be deemed to have been signed and entered into force upon the completion of the membership process, is to determine the terms of use of the member from the website of Marions, www.marions.com.tr.

3. Rights and Obligations of the Parties

3.1. The Member declares and undertakes that the personal and other information that he/she has given while registering on the www.marions.com.tr website and that he/she has confirmed and declared to be correct is correct before the law, and that he will immediately and immediately indemnify all damages incurred by Marions due to the falseness of this information. .

3.2. The member accepts, declares and undertakes that he/she will not give the password he/she has created while becoming a member of www.marions.com.tr to any real or legal person other than himself/herself. It is forbidden for members to share their membership passwords with others. The right to use the said password belongs to the member himself. Marions is not responsible for the security and confidentiality of the passwords created by the member during registration or changed after registration, and the e-mail or phone number to which the membership is linked. This responsibility belongs entirely to the member. The Member is solely and solely responsible for all responsibility that may arise in case this password is shared with others, and against all claims and demands that may be brought against Marion by third parties or authorized authorities. The Member agrees, declares and undertakes to cover all the damages that Marions has suffered or will suffer due to such unauthorized use. The rights of compensation and other claims of Marios are reserved.

3.3. The Member accepts, declares and undertakes that he/she will comply with the laws, regulations and other legal regulations while using the www.marions.com.tr website and will exclusively bear all legal and penal sanctions, responsibilities and obligations arising from this if he/she does not comply with these provisions. Marions is not a party to the civil and criminal sanctions caused by the member, and these obligations belong to the member alone.

3.4. The member may not use the www.marions.com.tr website in any way contrary to the law and general moral rules. In addition, the member cannot use the www.marions.com.tr website in a way that infringes the intellectual and copyrights of others in a way that disturbs others. In addition, the member cannot engage in activities (spam, viruses, etc.) and actions that prevent, restrict or make it difficult for others to use the services offered by Marions.

3.5. The comments, ideas and opinions made by the members on the www.marions.com.tr website do not bind Marios in any way, and are solely the personal opinions of the commenter and the person expressing their ideas and opinions, and they bind the opinion owner. These views and opinions have no interest or connection with Marions. Marions has no responsibility for the damages that the member may incur due to the ideas and opinions expressed by the member, and the damages that the member may suffer due to the ideas and opinions expressed by the third parties. If Marions suffers any damage due to this action of the member or the third party, the right to recourse to the person who caused the damage is reserved.

3.6. Marions reserves the right to initiate legal and criminal action against members who do not comply with one or more of the provisions of this agreement. The member will be personally responsible for these transactions. The Member has agreed in advance not to claim compensation from Marions for any damage he may incur due to the use of the www.marions.com.tr website. Marios reserves the right to claim compensation against members who violate the terms of the Agreement.

3.7. The member who tries to access the software, systems and data of other members or other internet users without permission by using the website belonging to Marions fully undertakes the legal and penal responsibilities arising from this and Marions has no responsibility.

3.8. Marions can unilaterally delete a member's membership when necessary, and there is no need to get permission from the member for this. The member accepts this savings in advance. In this case, Marions has no liability.

3.9. The source codes, software and design of the www.marions.com.tr website are the property of Marios. Copyright, industrial property rights and/or other intellectual property rights regarding the matters listed are protected by relevant laws. The member hereby declares, accepts and undertakes that the mentioned matters shall not be used, acquired or changed without permission by the member. In addition, the intellectual property rights of the products offered for sale on the www.marions.com.tr website belong to Marions and cannot be used, acquired or changed by the member without permission. Marios reserves the right to claim compensation in case of violation of the mentioned issues by the members.

3.10. The name and Internet Protocol (IP) address of the Internet service provider used by Marions to improve and develop the www.marions.com.tr website and/or to access the site within the framework of legal regulations, the date and time the site was accessed, the pages accessed while on the site, and Some information may be collected, such as the Internet address of the Web site, which provides a direct connection to the site.

3.11. In order to provide better service to its users, to improve its products and services, and to facilitate the use of the site, Marios may use the personal information of its members in studies aimed at the special preferences and interests of its users. Marions reserves the right to keep a record of the member's actions on the www.marions.com website.

3.12. The www.marions.com.tr website contains protection systems in accordance with current conditions. In addition, the member himself must acquire the necessary systemic protection. 3.13. The person who is a member of Marions declares and accepts that he/she allows commercial electronic messages for product and service promotions, advertisements, campaigns, advantages, surveys and other customer satisfaction practices by Marios within the scope of the practices in force and/or to be enforced. The member can change this at any time from the personal profile screen on the website.

3.14. The member is entitled to collect the personal and shopping information and shopping and/or consumer behavior information that he/she has given in the past and/or will give in the future while becoming a member of Marios and/or in other ways, for the above purposes, to share and use with third parties if Marios deems it necessary. and declares and accepts that it allows its archiving. Unless the member notifies otherwise, he/she declares and accepts that he/she allows the data to be collected, shared with third parties, used and archived if deemed necessary by Marions when his/her membership ends. The Member declares and accepts that he/she will not claim any direct and/or indirect material and/or moral, negative and/or positive, in short, any damages due to the collection, sharing, use, archiving and access to the above-mentioned information and will not hold Marions responsible. . Marios stores and processes the personal data of its members in accordance with the Law on Protection of Personal Data No. 6698. 3.15. Marions, when a member's personal information is requested as a legal obligation or (a) to act in accordance with legal requirements or to comply with legal proceedings notified to Marions; (b) when it believes in good faith that it is necessary to protect and defend the rights and property of Marios.

3.16. Marions reserves the right to change the content of the site at any time, to change or terminate any service provided to users, or to delete user information and data registered on the Marions website.

3.17. Marions may change, update or cancel the terms of the membership agreement at any time, without the need for prior notice and/or warning in any form or form. Any provision changed, updated or repealed will be effective for all members at the time of publication.

3.18. The parties accept and declare that all computer records of Marios will be taken as the sole and true exclusive evidence, in accordance with Article 193 of the CPC, and that the said records constitute a contract of evidence.

3.19. In accordance with this membership agreement, Marions has the authority to send information e-mails to the e-mail addresses of its members and information SMS to their mobile phones. In case the member wishes to opt out of receiving e-mail and/or SMS, he/she will be able to cancel the e-mail and/or SMS sending from the “My Preferences” section in the “My Page” section.

3.20. Marions has the right to cancel an order that creates a suspicion of Fraud without prior notice to the member, and the member does not have the right to make any demands from Marions due to this cancellation.

4. Privacy

The member may not copy, reproduce or make available to third parties any source code, software, engineering of the website of Marions with the domain address www.marions.com.tr. In addition, it cannot violate the intellectual property, industrial property and copyrights of the website and its contents. In case of violation of these matters, Marios reserves the right to demand compensation and compensation.

5. Termination of Contract

This agreement will remain in effect until the member cancels his/her membership or his/her membership is canceled by Marios. In the event that the member violates any provision of the membership agreement, Marios may terminate the agreement unilaterally by canceling the membership of the member.

6. Settlement of Disputes

Turkish Law will be applied in the resolution of disputes related to this contract and Istanbul Bakırköy Courts and Enforcement Offices are authorized.

7. Enforcement

Membership registration means that the member has read all the articles in the membership agreement and accepted the articles in the membership agreement. This Agreement was concluded at the time of the member's membership and entered into force mutually.

Fulfilling the legal obligations of our company, especially the Law on the Protection of the Consumer, the Law on the Regulation of Retail Trade and the Law on the Regulation of Electronic Commerce,

Providing information to the authorized institutions based on the legislation and fulfilling the requests of official institutions,

Ensuring the legal, technical, commercial and occupational safety of our company and the persons who have a business relationship with our company,

Determining and implementing our company's commercial and business strategies,

Planning and execution of customer satisfaction and corporate communication activities,

Carrying out raffles, campaigns, competitions, promotions or advertising activities,

Keeping personal data for the duration of the general statute of limitations, in order to provide evidence in the follow-up and execution of legal affairs and possible disputes that may occur in the future,
